All other passengers ÿþ<brÿþ>ÿþ The passengers denied boarding are to be offered rebooking to first available flight. When the passenger is denied boarding and he/she refused to give up their reservation, he/she has the right to compensation of damage amounting to: ÿþ<brÿþ>ÿþ ÿþ<brÿþ>ÿþ - EUR 250 for all flights up to 1500 kmÿþ<brÿþ>ÿþ ÿþ<brÿþ>ÿþ - EUR 400 for all flights withing European Community exceeding 1500 km, and for all other flights between 1500 and 3500 km ÿþ<brÿþ>ÿþ<brÿþ>ÿþ - EUR 600 for all other flightsÿþ<brÿþ>ÿþ<brÿþ>ÿþ This compensation will be realised by issuance of MCO to the adequate amount. The flight coupon is not to be retreived from the passenger's ticket as an exchange for the compensatory payment. When the passenger is offered rerouting, the timing of which does not exceed two hours of the regural original timing (for the flights up to 1500 km); three hours for the flights from 1500 km to 3500 km); four hours for all other flights YM can reduce the compensation by 50%. ÿþ<brÿþ>ÿþ<brÿþ>ÿþ Apart from this compensation the passenger is:ÿþ<brÿþ>ÿþ - refunded the total ticket amount in case that he/she does not want to continue with the travel orÿþ<brÿþ>ÿþ - he/she is offered appropriate rerouting to the destination point. ÿþ<brÿþ>ÿþ<brÿþ>ÿþ Every passenger is within this compensation offered two telephone calls, food, refreshment, and hotel accomodation with the transfer in cases when additional stay of one or more nights. ÿþ<brÿþ>ÿþ ÿþ</span>ÿþ ÿþ<strongÿþ>ÿþ<brÿþ>ÿþ<brÿþ>ÿþ 1.4 PROCEDURE IN CASE OF DELAY ÿþ</strong>ÿþ<brÿþ>ÿþ<brÿþ>ÿþ REFUND AND REROUTING;ÿþ<brÿþ>ÿþ STOWING AT THE AIRPORTÿþ<brÿþ>ÿþ<brÿþ>ÿþ<spanÿþ ÿþclass="style16"ÿþ>ÿþ When Montnegro Airlines reasonably expects the flight delay, other than scheduled departure time:ÿþ<brÿþ>ÿþ - of two or more hours in case of flights up to 1500 or lessÿþ<brÿþ>ÿþ - three or more in case of all flights within European Community and all other flights from 1500 to 3500 kmÿþ<brÿþ>ÿþ - of four hours or more in case of all fligths not falling into the above mentioned ones. ÿþ<brÿþ>ÿþ ÿþ<brÿþ>ÿþ Passengers are offered with no further expenses: food and refreshment in accordance with the time of waiting, two telephone calls, hotel accomodation when necessary, transport from the airport to the place of accomodation.ÿþ<brÿþ>ÿþ<brÿþ>ÿþ When the delay is no less than five hours and the passenger decides not to fly, he/she has the right to compensation amounting to the full value of their ticket. ÿþ</span>ÿþ ÿþ<strongÿþ>ÿþ<brÿþ>ÿþ<brÿþ>ÿþ<brÿþ>ÿþ 1.5 PROCEDURE IN CASE OF THE CANCELLED FLIGHTÿþ</strong>ÿþ<brÿþ>ÿþ<brÿþ>ÿþ REFUND AND REROUTING;ÿþ<brÿþ>ÿþ STOWING AT THE AIRPORT;ÿþ<brÿþ>ÿþ COMPENSATION ÿþ<brÿþ>ÿþ<brÿþ>ÿþ<spanÿþ ÿþclass="style16"ÿþ>ÿþ In case of the cancelled flight the passenger will be offered to opt between:ÿþ<brÿþ>ÿþ<brÿþ>ÿþ - compensation within the seven day's time equal to the amount of the full price of passenger's ticketÿþ<brÿþ>ÿþ - rerouting under the comperable conditions of transport towards the final destination as soon as possibleÿþ<brÿþ>ÿþ - rerouting under the comperable conditions of transport towards the final destination on the later date.ÿþ<brÿþ>ÿþ<brÿþ>ÿþ Apart from that the passenger has the right to free meals, refreshment, two telephone calls as well as to the financial compensation calculated in the same manner as in the case of overbooking. There are situations when the passengers of the cancelled flight do not have the right to compensationÿþ<brÿþ>ÿþ ÿþ<brÿþ>ÿþ- if they were informed about the cancellation two weeks prior to the scheduled flight - if they were informed about the cancellation at least one week prior to the flight and if they are offered rerouting on the flight the departure time of which can be no less than two hours earlier, and the arrival time does not exceed after the scheduled flight or ÿþ<brÿþ>ÿþ- if they are informed within seven days prior to departutre and their rerouting time is no less than one hour prior to the originally scheduled departure time and more than two hours after the originally schedulled departure time. ÿþ<brÿþ>ÿþ<brÿþ>ÿþ Note: An airline can refuse the compensation in case of a cancelled flight if it can prove that the cancellation was caused by extraordinary circumstances (due to weather conditions, safety measures, strikes or in case of transportation restrictions (the strike of the airline staff does not fall into this group)) which, regardless of all efforts could not have been avoided. ÿþ</span>ÿþ<brÿþ>ÿþ<brÿþ>ÿþ<brÿþ>ÿþ<strongÿþ>ÿþ 1.6. PROCEDURE IN CASE OF UPGRADE AND DOWNGRADEÿþ</strong>ÿþ ÿþ<brÿþ>ÿþ<brÿþ>ÿþ<spanÿþ ÿþclass="style16"ÿþ>ÿþ In case when carrier involuntarily overseats a passenger in cabin class which is higher than the one originally paid, the carrier shall not be entitled to any additional collection. ÿþ<brÿþ>ÿþ<brÿþ>ÿþ In case when the passenger agrees to be seated in cabin class that is lower than the on originally paid to be able to fly on flight on which he/she has a confirmed booking, the carrier must provide a compensation to the passenger not later then seven days after the flight for amount determined as follows: ÿþ<brÿþ>ÿþ- 30% of fare paid for all flights under 1500km ÿþ<brÿþ>ÿþ- 50% of fare paid for all flights within EU that exceed 1500km, and for all the flights with distance between 1500km and 3500km ÿþ<brÿþ>ÿþ- 75% of fare paid for all flights whose distance is more then 3500km ÿþ</span>ÿþ<brÿþ>ÿþ<brÿþ>ÿþ<brÿþ>ÿþ<strongÿþ>ÿþ 1.7.
